====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 15.5.2018, seek bail in Kopa PS Case No. 164 of 2017 registered under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the IPC. The allegation in brief is that quarrel took place for cutting muster crop from the field of the informant by the accused persons, the petitioners subsequently assaulted him, it is alleged that Uma Shankar Rai gave a knife blow on his chest and Sonu Rai gave a knife blow on his back, Nanhki Rai and Gautam Rai made assaulted by iron rod causing facture in his hand.
Learned Counsel for the petitioners submits that the quarrel took place on trivial issue, there is no repetition of blow by the petitioners, the injuries are simple in nature, as far as allegation of causing fracture on the hand of the informant is not specific rather it is against two persons Gautam Rai and Nanhki Rai and both the petitioners have clean antecedent.
Having considered the said facts and circumstances, the petitioners, namely, Umashankar Rai, and Nanhi Rai @ Ramashankar
Patna High Court Cr.Misc. No.35932 of 2018 (2) dt.28-06-2018 Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IVth Saran in connection with Kopa PS Case No. 164 of 2017.
