2. The petitioner seeks regular bail in connection with a case lodged on 21.07.2023 under Sections 341, 323, 324, 307, 354, 448, 380 and 504/34 of the Indian Penal Code.

3. As per the prosecution case, the present FIR has been lodged against three named accused persons including the petitioner alleging therein that the petitioner after entering into the house of the informant caught her arm with bad intention. On protest being made, the petitioner not only assaulted the informant's husband but also other family members of the informant with a knife, as a result of which, they got injured.

4. Learned counsel for the petitioner submits that the

It is a false case and only due to a land dispute, the present case has been lodged. From the allegation made in the FIR, it transpires that for the purpose of construction of the house, a dispute has arisen. Learned counsel further submits that the petitioner and the informant both are gotia. The injury report has been annexed as Annexure-2 series, which suggests that all the injuries are simple in nature. The petitioner is in custody since 24.07.2023 having no criminal antecedent.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st Class, Saharsa, in connection with Saharsa Sadar P.S. Case No. 476/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
