24-09-2018 A counter affidavit has been filed today.

On going through the statement made therein it appears that son of the petitioner about whom it is stated that he is missing, is an accused in Malsalami P.S. Case No. 213/2007 for the offences alleged under Section 147/148/323/ 324/504/307/302 of the Indian Penal Code and 3/4 of the Explosive Substance Act. He was on bail but thereafter he is missing. Patna High Court Cr. WJC No.1650 of 2018 (3) dt.24-09-2018 affidavit says that he has become traceless as he was apprehending his conviction in the aforesaid case. It is further stated in the counter affidavit that against him even process under Section 83 & 83 of the Cr.P.C. have been issued and the police is in search of him.

In the given facts and circumstances of the case, this court sitting in its writ jurisdiction is not inclined to pass any order particularly the directions which the petitioner is looking for against the police authorities.

This Writ Application has no merit. It is dismissed, accordingly.
