2. The petitioner seeks bail in connection with Motihari Town P.S. Case No. 733/2024 registered for the offences punishable under Sections 318(4), 336(3), 338, 340(2), 329(3) and 3(5) of B.N.S.

3. As per the prosecution case, petitioner is accused of selling the land which was purchased by the mother of the informant by a registered sale deed.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is next submitted that petitioner has all the rights to sell the land

Patna High Court CR. MISC. No.91559 of 2025(5) dt.30-03-2026 2/2 belonging to the informant and his family as the informant's family has sold more than their share. Learned counsel further submits that the title suit is pending and since the informant has sold more than his share, the petitioner has got every right to sell the land which is standing in the name of the mother of the petitioner. Petitioner has four criminal antecedents and he is in custody since 09.10.2025. The petitioner undertakes to cooperate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner

Considering that no submission has been made as to how much land has been sold by the informant or his family members, prima facie I am of the view that considering the pendency of the civil dispute, the petitioner should not have sold the land which has been purchased in the name of the petitioner's mother, hence, this Court is not inclined to grant bail to the petitioner.
