2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 325, 307, 302 and 504 of the Indian Penal Code, registered in connection with Nutan P.S.Case No. 304 of 2022.

3. The matter stems from the land dispute. It so happened that on the order of co-accused Ramnath Yadav, the petitioner assaulted Bachcha Yadav (informant' son) with farsa on his head, causing him to fell down. Thereafter other accused persons, assaulted the victim with lathi and danda. He was brought to a hospital for

4. The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated due to land dispute. The petitioner carries no previous criminal history and is the victim of circumstances.

5. The report of the learned trial court sent through Letter No. 81/2025 dated 18.07.2025 shows that out of eight charge-sheeted witnesses, six have been examined. Only the Doctor and the I.O. remain to be examined

6. Considering the facts and circumstances of the case and in view of graveness of allegation, I am not inclined to grant the petitioner the privilege of bail.

7. The learned trial court is directed to conclude the trial within a period of three months. No date for more than 10 days shall be fixed in this case.

8. The Superintendent of Police, Bettiah,West Champaran, is directed to ensure the appearance of the doctor and the I.O. in the court below for their examination. If the I.O. and the doctor appear in the court below, their examination-in-chief as well as their cross-examination shall be concluded on the same day.
