2. This criminal appeal has been filed against the order dated 23.11.2023 passed by learned Exclusive Special Judge SC/ST, Saran at Chapra in ABP No. 3966 of 2023 arising out of Rivilganj P.S. Case No. 302 of 2023 registered under Sections 341, 323, 379, 504, 506 of the Indian Penal Code and Section 3 (i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, on the alleged date and time of occurrence, this appellant abused informant by caste
Patna High Court CR. APP (SJ) No.205 of 2024(3) dt.05-09-2024 2/2 name and assaulted him by means of iron rod due to which shoulder of informant got fractured. Doctor has found grievous injury.
4. Considering the nature of accusation and grievous injury, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected. (Prabhat Kumar Singh, J) Navya/- U T
