2. The petitioner seeks bail in connection with Piprasi P.S. Case No. 74 of 2025 dated 10.09.2025 instituted for the offence punishable under Sections 103(1), 238, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, on the alleged date of occurrence, the husband of the informant, namely, Raushan Bin went to collect wood from river with accused persons as named in the F.I.R. All the accused persons returned except informant's husband. When the informant asked accused persons about her husband, they stated that he drowned in the river. Thereafter, dead body of Raushan Bin was searched by family members of the informant as well as N.D.R.F., but it could not be traced out.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner further submits that the occurrence took place on 01.09.2025 while the F.I.R. has been lodged on 10.09.2025 after nine days of the occurrence without any plausible explanation. It is further submitted that after investigation, the police submitted charge-sheet under Section 105, 3(5) of Bhartiya Nyaya Sanhita. After recovery of the dead body, the post-mortem was done, but the post-mortem report does not disclose any external injury. There is no material against the petitioner which would connect him to this case. Only on the basis of suspicion, the petitioner was taken into custody. Lastly, it has been submitted that the petitioner is in custody since 30.09.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let

No.87082 of 2025(3) dt.11-02-2026 3/3 the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bagaha, West Champaran in connection with Piprasi P.S. Case No. 74 of 2025.
