JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barharia P.S. Case No.149 of 2018 for the offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 34(B)/36/38 of the Bihar Excise and Prohibition Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 27.05.2018 in connection with seizure of 5 litres of Mahua wine. He further submits that the alleged Mahua wine was seized from the back side of the house of the petitioner and not from the conscious possession of the petitioner.

Considering the fact that the petitioner has remained in custody for nearly one and half months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds

Patna High Court Cr.Misc. No.40067 of 2018 (2) dt.10-07-2018 2/2 of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Barharia P.S. Case No.149 of 2018.
