====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Kishanganj P.S. Case No.244 of 2019 registered under Sections 420, 379, 411 and 414 of the Indian Penal Code. The accusation is that the mobile set having two SIMs of the informant was snatched in the evening of 04.05.2019. On inquiry from the Technical Cell of the office of the Superintendent of Police, Kishanganj, the informant came to know that the mobile set of the informant is being used by Mehrul Haque of village-Kachra Gopalpur by using two other SIMs. The informant further came to know that Sonu Gupta and Ravi Gupta (petitioner) used to commit theft of the mobile

No.791 of 2020(2) dt.21-01-2020 2/3 set and sell the same in low price and Mehrul Haque had come at the Bus Stand, Kishanganj for the purpose of purchasing the stolen mobile. Thereafter, the police party reached at the Bus Stand Kishanganj. On seeing the police party, two persons tried to flee away on a motorcycle having no registration number but they were apprehended, who disclosed their name as Mehrul Haque and Mujibur Rahman. On search, Mehrul Haque was found in possession of one mobile set having two SIMs, whereas Mujibur Rahman was found in possession of one mobile set having one SIM and both disclosed that the said mobile sets have been purchased by them from Sonu Gupta and Ravi Gupta (petitioner), who used to do the work of committing theft of the mobile and sell the same.

Learned counsel appearing on behalf of the petitioner submits that the petitioner after being apprehended was remanded in this case on 07.08.2019 and since then he is in custody. Further submission is that the similarly situated coaccused Sonu Gupta alias Sonu Kumar Gupta has already been granted bail by a Bench of this Court vide order dated 13.12.2019 passed in Criminal Misc. No.82858 of 2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released
