Mr.Umesh Lal Verma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 05-02-2025 Heard Mr. Brajesh Prasad Gupta, learned counsel appearing on behalf of the petitioners and Mr. Umesh Lal Verma, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Desari P.S. Case No. 243/2024 registered for the offence(s) punishable under Sections 191, 329(3), 329(4), 109, 352 of BNS and Section 27 of the Arms Act.

3. As per the allegation made in the FIR, the accused persons named therein came at the house of the informant and started firing and when the villagers came there they fled away.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent they have

Patna High Court CR. MISC. No.1188 of 2025(2) dt.05-02-2025 2/2 been roped in the present case because they are cousins of coaccused Umesh Rai, with whom the informant has land dispute. Petitioners have clean antecedents.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made in the FIR, as well as, the fact that petitioners have clean antecedents, I am of the opinion that petitioners have, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XI, Vaishali at Hajipur/ Successor Court in connection with Desari P.S. Case No. 243/2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
