Petitioners seek bail in Sessions Trial No.65 of 2017 / 445 of 2017 arising out of Fatehpur P.S.Case No.192 of 2012 registered for the offences under Sections147, 148, 302, 307, 504, 323 of Indian Penal Code and Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioners submits that the prayer for bail of the petitioners is refused four times lastly vide order dated 31.01.2018 passed in Cr.Misc.No.50163 of 2017 with direction to the trial court to conclude the trial of the petitioners within four months. If the trial of the petitioners is not concluded within four months, the petitioners would be at liberty to renew their prayer for bail. In

Patna High Court Cr.Misc. No.44861 of 2018 (2) dt.25-07-2018 2/2 spite of passing over more than five months the trial of the petitioners has not been concluded by the trial court and the record is running for prosecution evidence. Further submission is that both the petitioners are in custody since 25.03.2013. Having considered the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, 1st , Gaya, in S.Tr.No.65 of 2017 / 445 of 2017 arising out of Fatehpur P.S.Case No.192 of 2012.
