2. Learned counsel for the petitioner is permitted to remove Defect No. 6(1) during course of the day itself.

3. At this stage, it is submitted by learned counsel appearing for the petitioner that present application has been filed for restoration of Cr. Misc. No. 47354 of 2015, which was dismissed for default in want of prosecution vide order dated 19.06.2024.

4. It is submitted that non-appearance of learned counsel was neither intentional nor

Patna High Court CR. MISC. No.7957 of 2025(2) dt.14-02-2025 2/2 deliberate rather due to certain compelling circumstances which was beyond the reach of learned counsel appearing for the petitioner. However, petitioner seeks unqualified and unconditional apology to this Court.

5. Considering the aforesaid submission and for the reasons stated in the petition itself, Cr. Misc. No. 47354 of 2015 now restored to its original file and number.

6. Accordingly, the present restoration application stands allowed.

7. Upon restoration, re-notify aforesaid Cr.

Misc. No. 47354 of 2015 on 3rd March, 2025 before appropriate Bench.
