The petitioner seeks bail in a case for the offence registered under Sections 379 and 356 of the IPC. The prosecution story, in brief, is that on 28.09.2019 while the informant was going to Kumarkhand from his house through his Motorcycle, two persons riding on a Motorcycle stopped him and one of them, took Rs. 10,000/- and other things from him. On alarm made by the informant, petitioner was apprehended and one Motorcycle and two Mobiles have been recovered from his possession. Other person as Mantu Kumar Yadav fled away from the place of occurrence. It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.82069 of 2019(2) dt.18-12-2019 2/2 petitioner that the petitioner is in custody since 29.09.2019. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no recovery of stolen property from possession of the petitioner, this falsifies the prosecution case. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Madhepura, in connection with Shrinagar P.S. Case No. 58 of 2019.
