1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in anticipation of her arrest in a case registered for the offences punishable under Sections 80 and 3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and the informant alleges that his sister was married to Santosh Prasad on 26.02.2020. After marriage, the husband along with accused persons including the petitioner were demanding a motorcycle and on account of non-fulfillment of the demand, the victim was tortured. No.87402 of 2025(4) dt.15-05-2026 2/3 know that the victim was killed, accordingly he asked his sister to verify about the occurrence, as the informant was out of station in connection with earning, accordingly, his sister went to the place of occurrence and found the dead body of the victim lying.
4. The learned counsel for the petitioner submits that petitioner being sister-in-law (Gotni) has been falsely implicated in the instant case by the informant. It is also submitted that informant is not an eye witness to the occurrence and the entire allegations hinges around suspicion. It is also submitted that petitioner and her husband are residing separately from the husband of the deceased. It is next submitted that Paspati Devi, (mother-in-law of the deceased) had approached this Court seeking anticipatory bail by filing Cr. Misc. No.81033 of 2025 and the same came to be allowed by an order dated 19.01.2026 after considering the case on merit and in detail. It is further submitted that the case of the petitioner is on a better footing. It is also submitted that Paspati Devi also resides with the petitioner and her husband. It is further submitted that if privilege of anticipatory bail is granted, the petitioner will not abscond rather will cooperate in the investigation to prove her innocence.

Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application but then are not in a position to rebut the submission of learned counsel appearing on behalf of petitioner that Paspati Devi has been granted the privilege of anticipatory bail by order dated 19.01.2026 in Cr. Misc. No.81033 of 2025, after considering the case on merits and in detail.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Sidhwaliya P. S. Case No.105 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
