By way of this writ application, the petitioner has prayed for the following reliefs:- (i) To issue an appropriate writ(s), order(s) or direction(s) commanding thus directing the Respondent(s) concerned to quash the letter dated 20.11.2024 issued under signature of the Respondent no.-5 to the officer-in-charge, Harnaut Police Station thus unfreeze the Bank Account belonging to the petitioner aforesaid:- (i) HDFC Bank Account No.- 99999204234865

2/4 (ii) Canara Bank Account No.- 110130181020 (iii) Union Bank Account No.- 40950201008406 Which has been freezed by the Respondent police authority of District-Nalanda vide the impugned letter aforesaid though in most arbitrary and whimsical manner, moreover constraining legal rights of the petitioner.

(ii) Further to issue an appropriate writ(s) whereby and under an appropriate legal action be taken against erring official of the Respondent State of Bihar and/or grant any other relief/reliefs befitting in the facts and circumstances of the case.

3. This Court, on 21.04.2025 had passed the following order in this case:- Heard learned counsel for the petitioner;

learned APP for the State and learned counsel for the informant, who has appeared suo motu.

2. Mr. Binit Kumar, learned counsel for the petitioner submits that the petitioner is ready to execute the sale deed in favour of the informant.

3. Learned counsel for the petitioner and learned counsel for the informant are given two weeks time to complete the formalities of execution of the sale deed. If the sale deed is executed then thereafter this Court will examine the prayer of the

3/4 petitioner as to whether the amount of Rs. 2 crores shall be released in his favour or not.

4. For the next two weeks, the petitioner shall not be arrested in connection with the Harnaut P.S. Case No. 399 of 2024. This protection shall automatically be vacated after two weeks, if not extended by this Court.

5. List this case after two weeks.

4. Pursuant to the order of this Court on 21.04.2025, the sale deed has been executed in favour of the informant on the orders of the District Magistrate, Nalanda by the Registrar.

5. Since the learned counsel for the informant submits that the land has come in possession of the informant, this application is allowed. Accordingly, the following bank accounts are directed to be de-frozen forthwith:- (i) HDFC Bank Account No.-99999204234865 (ii) HDFC Bank Account No.-99997004775486 (ii) Canara Bank Account No.-110130181020 (iv) Union Bank Account No.-40950201008406

6. It is also observed that the petitioner will not create any trouble for the informant in near future on the land which has been transferred.

7. Since the petitioner has not complied with the orders of this Court on time and the District Magistrate, Nalanda

4/4 had to interfere in the transfer, a cost of Rs. 50,000/- is being imposed upon the petitioner which shall be deposited in the Patna High Court Legal Services Authority within four weeks from today.
