The petitioner seeks bail in a case registered under Section 67 as Amended by I.T. (Amendment) Act, 2008. Prosecution case, in short, is that the informant is Administrator of a Whatsapp group named as Cyber Senani, Banka. On 13.10.2019 at 16.30 hours, the petitioner being a member of the aforesaid group cast a sexual image in the aforesaid group, which is against the group of law. It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.11.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. From the whatsapp number of the petitioner, certain objectionable photos were sent.

No.81422 of 2019(2) dt.18-12-2019 2/2 It has also been submitted on behalf of the petitioner that the mobile in question has been misused by some other persons with an intention to falsely implicate the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. case No.735 of 2019.
