2. Learned counsel for the petitioner is permitted to make necessary correction in the paragraph no. 6 of the bail petition.

3. The petitioner seeks bail in connection with Sessions Trial No. 495 of 2023 arising out of Ara Muffasil P.S. Case No. 117 of 2023 registered for the offence under Section 302, 201, 120B and 34 of the Indian Penal Code.

4. As per the prosecution case, the dead body of the deceased was recovered from a field.

5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted by the learned counsel for the petitioner that during investigation it has come that the

6. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 15.03.2022.

7. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

8. Considering the aforesaid facts and the period of custody, this application is allowed.

9. Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VIII, Bhojpur at Ara in connection with Sessions Trial No. 495 of 2023 arising out of Ara Muffasil P.S. Case No. 117 of 2023.

10. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on the dates fixed for hearing.
