2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Fatuha P.S. Case No. 478 of 2022 registered for the offences punishable under Sections 30(a)of the Bihar Prohibition and Excise Act and 399, 402, 414, 420 of the IPC and Section 25(1-b)(a), 26 , 35 of the Arms Act.

3. The allegation against the petitioner is to have in possession of stolen motorcycle which alleged to be looted one.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is a man of

It is pointed out that occurrence was not in knowledge of this petitioner and moreover, the recovery of motorcycle not appears from the conscious physical possession of this petitioner. It is also submitted that compliance of Section 100(4) of Cr.P.C. regarding search of premises also not appears followed in present case.

5. Learned APP, opposes the prayer of bail.

6. In view of aforesaid factual submission and by taking note of nature of accusation coupled with the fact that recovery of stolen motorcycle not appears primafacie from the conscious physical possession of this petitioner who is a man of clean antecedent, accordingly, petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
