Petitioner prays for bail in connection with Mehsi P.S.Case No. 102 of 2013, corresponding to Trial No. 2875 of 2018, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Allegation against the petitioner is of committing theft in the house of the informant.

Submission of learned counsel for the petitioner is that petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused and he is in custody for seven months and except confessional statement there is nothing against him.

Heard learned APP and from perusal of the report it

Patna High Court Cr.Misc. No.47691 of 2018 (3) dt.20-09-2018 2/2 appears that the case has been fixed for evidence. In such view of the matter, I am not inclined to grant bail to the petitioner at this stage.

However, learned trial court is directed to conclude the trial within a period of six months. If trial is not concluded within the said period, the petitioner shall be released on bail by the trial court to its own satisfaction.

With the above observation, this application is disposed of.
