The petitioner seeks bail in connection with Tilouthu P.S. Case No. 160 of 2019, registered under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code. The accusation is that in the morning of 18.09.2019, Santosh Giri and Sushil Giri (petitioner), both sons of Bipin Bihari, came at the door of the informant, Akhilesh Giri, and started to abuse. When, informant made protest, then, petitioner Sushil Giri caught hold of him and Santosh Giri gave the knife blow on his left chest, left hand and ear. When, Deepak Kumar Giri, nephew of the informant, rushed to save him, then, he was also given knife blow.
Submission is that while the petitioner is named in the first information report, but, the assailant of the informant and

No.81308 of 2019(2) dt.18-12-2019 2/2 his nephew is Santosh Giri, brother of the petitioner and the petitioner being the brother of co-accused, Santosh Giri, has been implicated in this case with allegation of catching hold of the informant at the time of assault. The petitioner has no criminal antecedent and is in custody since 19.09.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Tilouthu P.S. Case No. 160 of 2019 to the satisfaction of the Judicial Magistrate, 1st Class, Dehri-on-Son, Rohtas.
