2. The petitioner seeks bail in a case registered for offence under Sections 127(1), 115(2), 109, 3(5) of the Bhartiya Nyaya Sanhita and Sections 25(1-b)a, 26, 27, 35 of Arms Act.

3. The prosecution case, in brief, is that on the alleged date and time of occurrence, this petitioner made a call on mobile phone of informant's brother and asked him to come near Durga temple to talk regarding ongoing land dispute between them. It is further alleged that when informant and his brother reached there, they found this petitioner and co-accused Abhimanyu Singh and Abhishek Singh present there and thereafter, it is alleged that this petitioner and co-accused Abhimanyu Singh started indiscriminate firing, as a result of which, one bullet hit on the waist of informant's brother.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to admitted land dispute. In this regard, a title suit i.e. Title Suit No. 493 of 2023 is already pending between the parties in the Court below. Allegation of firing is against this petitioner and co-accused Abhimanyu Singh, who has already been granted anticipatory bail by this Court, vide order dated 27.01.2025 passed in Cr.Misc. No. 38959 of 2024. Petitioner is in custody since 22.10.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Sasaram (T) P.S. Case No. 605 of 2024.
