2. Learned counsel for the petitioners, at the very outset, prays for and is permitted to withdraw this application filed on behalf of petitioner no. 1 namely Chameli Devi @ Laichi Devi.

3. Accordingly, this application is dismissed as withdrawn for petitioner no. 01 and she is directed to surrender within four weeks from today and pray for regular bail in the Court below. Now this application is only restricted to petitioner no. 02 namely Baliram Sah @ Bharat Sah.

4. The petitioner no. 2 apprehends his arrest in

Patna High Court CR. MISC. No.90202 of 2024(2) dt.05-02-2025 2/3 connection with Maharajganj P.S. Case No. 200 of 2023 registered for the offence under Sections 304(B), 201 and 34 of the Indian Penal Code.

5. As per the prosecution case, the petitioner no. 02 is alleged to have been involved in the killing of the deceased.

6. It has been submitted by the learned counsel for the petitioners that the petitioner no. 2 is the Dewar of the deceased and the junior member of the family. It has further been submitted that the allegation levelled against petitioner no. 2 is general and omnibus.

7. Considering the facts of the case and also considering that the petitioner no. 02 is the junior member of the family and the allegation against him is general and omnibus, this application for grant of anticipatory bail to the petitioner no. 02 is allowed.

8. Let the petitioner no. 02, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Siwan in connection with Maharajganj P.S. Case No. 200 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

9. As a condition of this order, the petitioner no. 02, after being released on anticipatory bail is directed to cooperate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner no. 02. (Sandeep Kumar, J) Vikas/- U
