JUSTICE SANJAY PRIYA ORAL ORDER 26-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gaunaha P.S. Case No. 44 of 2018 instituted for the offence under Sections 376, 511 and 506 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 14.05.2018. Counsel for the petitioner further submits that petitioner has been implicated in the instant case due to village politics.

In the written report there is general and omnibus allegation against the petitioner that on 12.05.2018 when the informant was sleeping along with her children, petitioner entered into her house and attempted to commit illegal act with her. She anyhow managed to escape setting herself free. The

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with Gaunaha P.S.
