The petitioner has filed the instant application for grant of regular bail in connection with Tajpur P.S. Case no. 6 of 2017 registered under sections 302, 504, 506, 323, 324, 341, 448, 147, 148 and 149 of the Indian Penal Code.

Allegation as per the FIR is that as a result of some dispute with respect to transaction of money, the eleven named accused persons came variously armed at the door of the informant. It is further stated that Bablu Kumar Singh caught hold of the informant and started to beat him up. It is further stated that the four named accused persons including the petitioner herein caught hold of the informant's younger brother while Birendra Singh, Sushil Singh and Mukesh Singh stabbed him with a knife. The informant further states that Ajay Kumar Singh, Ranjay Singh and Kameshwar Singh beat up the informant's elder brother. It is further stated that the

It is submitted by learned counsel for the petitioner that from the FIR itself it would be evident that the petitioner is not stated to be the assailant. It is further submitted that co-accused Arjun Singh has been enlarged on bail vide order dated 20.7.2017 (Annexure-3) passed in Cr. Misc. No. 33878 of 2017. The petitioner has no criminal antecedent and is in custody since 7.6.2019. The application for bail is opposed by the learned APP for the State.

Having heard the learned counsel for the parties, in view of the facts and circumstances as sated above, the court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Tajpur P.S. Case No. 6 of 2017 on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District Judge -VI, Samastipur.
