JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Sursand P.S. Case No 341 of 2019 for offences under Sections 147, 148, 341, 323, 504, 332, 379, 353, 307 and 427 of the Indian Penal Code .

Allegation against the petitioners and 200-300 unknown persons is that they started pelting stones and bricks upon the police party which caused injuries to the police personnel and damaged the Government vehicles. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and there is no specific allegation of assault against them.

No.82040 of 2019(2) dt.11-12-2019 2/2 Considering the fact that the allegation of assault has been levelled against 200-300 unknown persons including the petitioners, this Court is inclined to grant bail to them. Let petitioners, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, learned J.M. 1st Class, Pupri at Sitamarhi in connection with Sursand P.S.
