This application for anticipatory bail arises out of Singheshwar P.S. Case No. 37 of 2018, disclosing offences under Sections 341, 323, 379, 385, 386, 504, 506 and 34 of the Indian Penal Code.
From the first information report, it appears that there is some dispute of title over a piece of land. It is alleged that the accused persons were attempting to fence the land at the gunpoint and when objected, they demanded an amount of Rs. 2,00,000/- as rangdari. It is alleged that they snatched a golden chain from the informant. Some cash was also snatched, allegedly by one Md. Ansar.
Learned counsel for the petitioner appears to be right
Patna High Court Cr.Misc. No.52133 of 2018(2) dt.28-09-2018 2/2 in his submission that certain land dispute is the main reason behind the lodging of the first information report. Considering the background of the case and submissions advanced on behalf of the petitioners, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Singheshwar P.S. Case No. 37 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
