Petitioner apprehends arrest in connection with G.R. No. 5043 of 2015 arising out of Rajeev Nagar P.S. Case No. 230 of 2015 registered for the offence punishable under sections 406/420 of the Indian Penal Code and section 3 of the Prevention of Damage to Public Property Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. He is merely a contractor and has no concern with the alleged land and the construction work going on there. During investigation also, nothing has come against this petitioner. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case
Patna High Court Cr.Misc. No.54126 of 2018(2) dt.12-09-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge III-cum- Additional Chief Judicial Magistrate, Patna in connection with G.R. Case No. 5043 of 2015 arising out of Najeev Nagar P.S. Case No. 230 of 2015 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
