The petitioner is languishing in custody since 19.08.2019 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. It is alleged that from the possession of the petitioner, one loaded country made pistol and a live cartridge was recovered.
It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present case and the investigation has already been concluded. Apart from the present case, the petitioner is accused in one other case registered under the provision of the Bihar Prohibition and Excise Act, 2016, but the petitioner has never been made
Patna High Court CR. MISC. No.81199 of 2019(2) dt.11-12-2019 2/2 accused in any Arms Act case from before.
Learned APP for the State submits that one loaded country made pistol and a live cartridge was recovered from the possession of the petitioner.
Considering the fact that the investigation has already been concluded and the petitioner has never been made accused in any Arms Act case from before, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea, in connection with Baisi P.S.
