====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-02-2025 Petition for pre-arrest bail of petitioner no.1 is dismissed as withdrawn.

2. Heard learned counsel for the petitioners no. 2 to 4 and the State.

3. Petitioners apprehend arrest in a case registered for the offence punishable under sections 80(2), 238(b) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and sections 3⁄4 of the Dowry Prohibition Act.

4. It is a case of dowry death. Marriage of informant's daughter was solemnized with one Shyam Bihari on 19.5.2021. Later on, accused persons started subjecting her to cruelty and harassment for non-fulfilment of demand of dowry. On 19.7.2024, informant received message on telephone that his daughter was killed by the accused persons and dead body was concealed somewhere. Learned counsel for the petitioner submits that these petitioners are innocent and have falsely been implicated in this case. petitioner no. 2 is Bahnoi, petitioner no.3 is Bhaisur and petitioner no.4 is Nanad of the deceased. There is general and omnibus allegation against the petitioners and no specific overt act has been alleged against

Patna High Court CR. MISC. No.699 of 2025(2) dt.10-02-2025 2/2 them. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners no. 2 to 4, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Barh, Patna in Barh Police Station Case No. 500/2024, subject to the conditions laid down under section 482 of the Bharatiya Nyaya Sanhita, 2023.
