The petitioner seeks bail in Piro (Hasan Bazar) P.S. Case No. 67/2017, instituted for the offence under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is in custody since 06.06.2018. He is not named in the written report. No T.I.P. has been held in this case. Nothing incriminating has been recovered from possession of this petitioner. Name of this petitioner has come in confessional statement of co-accused Sanjay Kumar @ Sanjay Yadav. It is further submitted that aforesaid Sanjay Yadav has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No.
Patna High Court Cr.Misc. No.55784 of 2018 (2) dt.08-10-2018 2/2 28869/2018 dated 28.06.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Bhojpur at Ara in connection with Piro (Hasan Bazar) P.S. Case No. 67/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
