2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, on secret information, police reached on the spot and apprehended one person while his associate managed to escape. One country made pistol and a cartridge was recovered from him. He took name of the petitioner as his associate who managed to escape.

4. Learned counsel appearing for the petitioner submits that petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. No incriminating article has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is also an accused for offence under Section 309 of the Bharatiya Nyaya Sanhita (BNS) which deals with robbery including theft or extortion involving the use of force or threats of harm.
