2. The petitioner is apprehending his arrest in connection with Dariyapur P.S. Case No. 652 of 2023 dated 01.10.2023 registered for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

3. As per the prosecution case, the co-accused Dhiraj Kumar Rai was apprehended from his house along with electronic device who disclosed that he along with others including the petitioner took Rs. 20,000- Rs. 30,000/- from each candidates by providing them question paper before the Constable recruitment examination. The screenshot of the Whatsapp chats was also recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.4210 of 2024(2) dt.22-02-2024 2/2 that the petitioner is innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner has no criminal antecedent mentioned in para 3 of the bail petition. No incriminating material has been recovered from the conscious possession of the petitioner,

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the allegation being general and omnibus, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Dariyapur P.S. Case No. 652 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
