2. The petitioner apprehends her arrest in a case registered for the offence under Sections 341, 307, 323, 324, 379, 354 and 504/34 of the Indian Penal Code . 3 . As per the prosecution case , while informant namely Sangeeta Devi was at her house , in the meantime , all the accused petitioner came there and committed maarpeet with her and also snatched her mobile phone .

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. As a matter of fact, there is land dispute between the parties and the present case is counter blast of Turkauliya P S Case No. 1259 of 2023 lodged by co-accused Poonam Devi against the informant and other and in retaliation this false and concocted case has been lodged against this petitioner. Though, there is allegation of assault against this petitioner but there is no injury report on the record to substantiate the allegation levelled against him.

Learned A.P.P. for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioner and submitted that there is specific allegation against this petitioner that he assaulted the husband of informant and has got 5 criminal antecedents in which most of them are of similar nature .
6. Considering the aforesaid facts, criminal antecedents of petitioner and other circumstances of the case , prayer for pre - arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
