Petitioner, who is in custody, seeks bail in connection with Hajipur Industrial Area P.S. Case No. 85 of 2018 registered for the offences punishable under Sections 302 and 120(B) of the Indian Penal Code under Section 27 of the Arms Act.

Informant who is the brother of deceased has alleged that petitioner along with other co-accused persons came on motorcycle and fired upon his brother and as a result of which he died. It has been stated that entire incident has been captured by a CCTV camera of Lucky Marble Shop. It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.56175 of 2018(3) dt.06-10-2018 2/2 that he is innocent. He has been falsely implicated in this case due to high handedness of the police. He is not named in FIR. He is in custody since 07.06.2018. It has been further submitted that similarly placed co-accused persons, namely, Shiv Kumar Singh and Mukesh Kumar Singh has been granted bail by coordinate Bench of this Court in Cr. Misc. No. 47292 of 2018 and 47703 of 2018 vide order dated 14.09.2018 and 06.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Industrial Area P.S. Case No. 85 of 2018.
