2. The petitioner is in custody since 14.08.2023 in connection with Mojahidpur Babarganj P.S. Case No. 271/2023 registered for the offence punishable under Sections 21(b) and 22 of the NDPS Act.
3. As per the prosecution case, 84 grams of brown sugar has been recovered from the petitioner.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel for the petitioner further submits that the recovery is of intermittent quantity. The petitioner has no criminal antecedents.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case,
Patna High Court CR. MISC. No.1804 of 2024(2) dt.18-01-2024 2/2 let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur in connection with Mojahidpur Babarganj P.S. Case No. 271/2023.
7. The petitioner is directed to mark his attendance in Khalgaon police station on 1st Sunday of every month failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
