JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 The petitioner seeks regular bail in connection with Dighwara P.S. Case No. 158 of 2019, registered for offences punishable under Sections 341, 323, 376, 504/34 of the Indian Penal Code.

Prosecution case is that one Amitaj Kumar took the victim girl on the plea that her father met with an accident, thereafter, co-accused Amitaj Kumar and other accused persons brought the victim girl to Patna and said Amitaj Kumar committed rape on her. Petitioner is also named in the F.I.R. It has been submitted on behalf of the petitioner that it is a case of consensual physical relation between the alleged victim girl and co-accused Amitaj Kumar. Moreover, there is no allegation against the petitioner of committing rape on the victim girl. Petitioner has no criminal antecedent and he has

Having heard both sides, in view of the submissions as above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -I, Chapra at Saran, in connection with Dighwara P.S. Case No. 158 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
