The petitioner seeks bail in S. Tr. No. 196/2018, arising out of Alipur P.S. Case No. 56/2017, instituted for the offences under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
It is alleged in the written report that for the dispute of land, petitioner along with other accused persons intercepted the informant. Petitioner is alleged to have caused injury with Khanti on the head of informant and his brother Munarik Yadav. Injury report of both injured has been annexed as Annexure-2 series, wherein doctor has found simple injury on the person of informant. Doctor has found one injury on the person of
Patna High Court Cr.Misc. No.57962 of 2018 (4) dt.29-10-2018 2/2 brother of informant, i.e. lacerated wound over right parietal region (4 1⁄2 x 1⁄2 x 1⁄2) inch caused by hard and blunt substance and opinion was kept reserved. Subsequently, in C.T. Scan report injury was found to be grievous in nature.
Learned counsel for the petitioner has submitted that there is case and counter case between the parties. Petitioner has clean antecedent. He is in custody since 24.05.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Asst. Sessions Judge IInd, Gaya in connection with S.Tr. No. 196/2018, arising out of Alipur P.S. Case No. 56/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
