2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/467 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, co-accused Taralal Deo impersonated him to be Dinesh Yadav and sold a piece of land to one Subhash Chandra Jha and credited sale proceeds of Rs.3 lacs to the account of his first wife/the petitioner.
4. Learned counsel for the petitioner submits that there is no allegation of cheating against the petitioner. It is the specific case of the informant that co-accused Taralal Dev cheated the informant and sold the land. She was already deserted by co-accused 10 to 12 years back. Petitioner has no concern with him and has played any role in the alleged episode. She has been made accused in the case merely because she is wife of co-accused Taralal Deo. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of

No.2118 of 2024(2) dt.31-01-2024 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Araria in Sikti (Bardaha) Police Station Case No. 158 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
