====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 15-02-2024 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant.

2. The petitioner is apprehending her arrest in a case in connection with Fathehpur P.S. Case No. 566 of 2023 dated 25.07.2023 registered for the offences punishable u/s 304(B), 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with co-accused persons is alleged to have killed the daughter of the informant due to non-fulfillment of demand of Rs. 5,00,000/- as dowry.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1335 of 2024(3) dt.15-02-2024 2/3 that the petitioner is innocent and has falsely been implicated in this case merely on suspicion. The petitioner is mother-in-law of the deceased has no concern with daily affairs of the deceased and her husband. The petitioner along with her husband have already been residing separately from the daughter of the informant. There is general and omnibus allegation against the petitioner. The postmortem report has shown no any external injury or even abrasion on any part of the body of the deceased. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State as well as learned counsel for the informant have vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances as well as material available on record, it is found that there is general and omnibus allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gaya in connection with Fatehpur P.S. Case No. 566 of 2023, subject to conditions as laid down

Patna High Court CR. MISC. No.1335 of 2024(3) dt.15-02-2024 3/3 under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
