====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Pramod Kumar Verma, learned counsel for the petitioner and Sri Shyam Bihari Singh, learned Addl. Public Prosecutor.

The sole petitioner, who is father-in-law of the complainant, apprehending his arrest in Complaint Case No.1212 of 2010, in which cognizance of offence has been taken under Section 498(A) of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender, primarily on the ground of parity.

Learned counsel for the petitioner submits that at least five accused persons have been granted anticipatory bail on 11.09.2018 vide Cr.Misc.No.54112 of 2018. Accordingly, on

Patna High Court Cr.Misc. No.58743 of 2018(2) dt.20-09-2018 2/2 the ground of parity, a prayer has been made for extending the privilege of bail to the petitioner.

Sri Shyam Bihari Singh, learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail. However, he has not disputed the fact that at least five other accused persons have been granted privilege of anticipatory bail.

Considering the fact that other five accused persons have been extended the privilege of anticipatory bail by this Court, there is no reason to pass a different order in the present case, Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Dani Singh be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Nawada in connection with Complaint Case No.1212 of 2010, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J.) nawalkrs/- U T
