The petitioner seeks pre-arrest bail in connection with Govindpur P.S. Case No.54 of 2017 registered under Sections 147, 148, 341, 323, 504, 379 and 354 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Ashok Yadav and Upendra Yadav having more or less identical allegation to that of the petitioner have already been grant pre-arrest bail vide order dated 01.10.2018 and 28.06.2018 passed in Cr. Misc. No.60743 of 2018 and Cr. Misc. No.32659 of 2018 respectively. He contended that there is case and counter case and the instant case has been instituted only due to political rivalry.

Learned counsel for the State has opposed the prayer

Patna High Court Cr.Misc. No.56912 of 2018 (2) dt.06-10-2018 2/2 for grant of pre-arrest bail to the petitioner. Having regard to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No.54 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
