The petitioner is languishing in custody since 02.08.2019 in a case registered for the offences punishable under Sections 392 and 412 of the IPC.

The prosecution case is that the informant's motorcycle was robbed, leading to registration of FIR against four unknown persons. It is alleged that during investigation, name of the petitioner sprang up on the confession of co-accused Mukesh Kumar. Subsequently, the alleged motorcycle was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house. Moreover,

Patna High Court CR. MISC. No.83997 of 2019(2) dt.18-12-2019 2/2 investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the name of the petitioner sprang up on the confession of co-accused person and the recovery has been made from the house of the petitioner.

Considering the fact that investigation has already been concluded and the period under custody, coupled with the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Purnea in connection with Baisi P.S.
