Petitioner seeks bail in Forbesganj P.S. Case No.744 of 2017 instituted for the offence under Section(s) 341, 323, 324, 354, 379 and 504/34 Indian Penal Code. Counsel for the petitioner submits that there is no any injury to brother of the informant, Md. Mojib. Alleged date of occurrence is 13.09.2017 and the First Information Report has been lodged after delay of 11 days on 24.09.2017. Petitioner is in custody since 02.07.2018.

In the written report, it is alleged that petitioner assaulted the brother of the informant, Md. Mujib, with Dabiya on the head.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.744 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
