2. The petitioner seeks regular bail in connection with Hajipur Industrial Area P.S. Case No. 163 of 2024 registered for the offence under Sections 109, 3(5) of the B.N.S and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is accused of assaulting the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 04.12.2024. It is further submitted that co-accused has already been granted bail by the Co-ordinate Bench of this Court vide order dated 12.05.2025 passed in Cr.

Patna High Court CR. MISC. No.87907 of 2025(2) dt.22-12-2025 2/3 Misc. No. 18354 of 2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts that co-accused has already been granted bail by the Co-ordinate Bench of this Court vide order dated 12.05.2025 passed in Cr. Misc. No. 18354 of 2025 and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur/concerned Trial Court in connection with Industrial Area P.S. Case No. 163 of 2024 subject to conditions that:- (i). The petitioner will mark his attendance at the Hajipur Sadar Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
