JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-03-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kotwali P.S. Case No. 562 of 2018 for the offenses under Section 392 of the Indian Penal Code.

Allegation against the petitioner is that he was involved in snatching bag containing 30,000/- cash and two mobile phones.

Learned counsel for the petitioner submits that petitioner has not been named in the FIR. The petitioner is in custody since 30.5.2019.

Considering the fact that the petitioner has remained in custody for nearly ten months, let the petitioner, above

Case No. 562 of 2018, subject to the condition that immediately after release the petitioner shall report to the Civil Surgeon, Gaya so that his services may be utilized as volunteer in the District Health Centre, Gaya for a period of one month.
