2. The petitioner has preferred this application for grant of regular bail in connection with Chanan P.S. Case No. 119 of 2019 dated 19.08.2019 registered for the offence/s punishable u/ss 302 read with section 34 of the Indian Penal Code, 27 of the Arms Act and 17, 18, 20, 23 of the U.A.P. Act.

3. As per the prosecution case, when the informant and his brother were taking tea at the tea stall, in the meantime, the co-accused person Rana Kumar Singh along with six unknown persons came there with various weapons and the coaccused Rana Kumar Singh shot the informant's brother on his

It is further alleged that the other unknown miscreants also fired due to that one Chhotu Sao died on the spot but the informant escaped anyhow, thereafter all the accused persons fled away by chanting slogans.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused Rana Kumar Singh. The petitioner is a lady. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 21.12.2020 passed in Cr. Misc. No. 22632 of 2020. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.2548 of 2025(2) dt.03-03-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Chanan P.S. Case No. 119 of 2019.
