JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khajekalan P.S. Case No. 222 of 2018 instituted for the offence under Sections 147, 148, 149, 323, 307, 504, 447/34 of the Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that the instant case has been filed on account of land dispute between the parties. In the written report there is no allegation of any specific overt act against the petitioner. It is alleged in the written report that co-accused Munna Sao fired from his pistol which passed just near from head of the informant. Thereafter, Chunnu Sao along with other accused persons started making firing. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.59502 of 2018 (2) dt.06-10-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna City, in connection with Khajekalan P.S. Case No. 222 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
