2. The petitioners seek bail in a case, registered for the offence punishable under Sections 191(2), 190, 103(1), 238(A), 352, 351(2),(3) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the FIR, due to land dispute, all the named co-accused persons, including these petitioners, killed the husband of informant and threw the dead body into a river.

4. Learned counsel for the petitioners submits that from bare perusal of FIR, it is apparent that informant is not eye-witness to the occurrence and only suspicion has been raised against petitioners only on account of previous dispute.

Patna High Court CR. MISC. No.89370 of 2025(2) dt.12-02-2026 2/2 Chargesheet has already been submitted. Petitioner no. 1 is in custody since 12.09.2025 and petitioner no. 2 is in custody since 16.09.2025 and both claim clean antecedent.

5. Learned APP opposes the prayer for bail of petitioners.

Considering the period of custody and clean antecedent, let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten thousand) each two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S.
