JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-12-2018 In the order dated 27.11.2018 it has been inadvertently mentioned as "Reference in this regard has been made to a judgment of the Division Bench reported in 2013(3) PLJR 706."
Let the aforesaid sentence be corrected and be read as follows:- "Reference in this regard has been made to a judgment of a co-ordinate Bench of this Court reported in 2013(2) PLJR 706".
Accordingly, the order dated 27.11.2018 stands modified to the aforesaid extent.
It is submitted by the learned counsel for the petitioner that since the petitioner has prayed for quashing of the order dated 31.07.2017 passed by the Sub-Divisional Officer,
Patna High Court CWJC No.18446 of 2018(3) dt.11-12-2018 2/2 Daudnagar and the same has been quashed, the appellate order dated 21.07.2018 passed by the District Magistrate, Aurangabad in P.D.S. Appeal Case No. 43 of 2017, is also bound to fall. Since, earlier by an order dated 27.11.2018, this Court had quashed the order dated 31.7.2017 passed by the S.D.O., Daudnagar, Aurangabad, the appellate order dated 21.07.2018 is also bound to fall and is accordingly quashed.
