1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Sultanganj Police Station Case No. 255 of 2023, dated 13.05.2023, disclosing offences under Sections 302/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 12.05.2023, at about 05:00 PM, the petitioners, along with other accused persons, came to the house of the informant and took away her husband towards field for a party. When the husband of the informant did not return over the night, she enquired about the same in the
Patna High Court CR. MISC. No.2482 of 2025(2) dt.28-01-2025 2/3 next morning and went to boring situated in the field with her neighbours, where she found her husband lying dead near the heater.
4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case due to village politics. He next submits that from the postmortem report, it appears that the deceased died due to asphyxia and shock caused due to contact with electric wire. He further submits that similarly situated coaccused person, namely, Horil Yadav, has been granted anticipatory bail by this Court in Cr. Misc. No. 67428 of 2024. The petitioners are in custody since 21.10.2024.
5. Regards being had to the submissions made by the parties and taking into consideration the period of custody and the fact that the similarly situated co-accused person has been granted anticipatory bail by this Court, I am inclined to grant regular bail to the petitioners.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate 1st,
